General terms and conditions of use E-Clinical 2.0

These Terms and Conditions are intended to define the terms and conditions of use of Eurofins E-Clinical application.

The use of this service implies for the user the unreserved acceptance of these terms and conditions. The consent given at the end of the form implies acceptance of the processing of any personal data collected online, in accordance with the regulations in force.

Article 1: PURPOSE 

The online system is for appointment booking, pre-registration, analysis progress and access to the results of clinical diagnostics tests. The registration form collects information necessary for the administrative management of the patient’s file by EUROFINS BIOLOGIE MEDICALE medical analysis laboratories.

The information entered by the patient on the form will allow automated referral requests to be generated in the management software of medical biology laboratories in order to perform clinical diagnostics tests.

Article 2: ACCEPTANCE AND AMENDMENT OF TERMS

Before validating the request, the user accepts these terms and conditions of use. EUROFINS BIOLOGIE MEDICALE reserves the right to modify them at any time and agrees to inform users by any means.

Article 3: PROCESSING OF PERSONAL DATA

As part of the use of E-Clinical tools, EUROFINS BIOLOGIE MEDICALE collects your personal data for the exclusive purpose of managing your request to be referred for clinical diagnostics tests in accordance with the Privacy Policy.

Article 4: USING AND ACCESSING THE FORM SERVICE

Fields marked with an asterisk on the registration form are mandatory. If these are not filled in, the registration request cannot be processed. In accordance with the legal and regulatory provisions in force, the user will have expressly consented to his/her personal information being shared with the laboratory before sending his/her request. Personal information will only be visible to the medical biology laboratory to manage the request to register for the screening campaign.

When the clinical diagnostics test result is available, the user will receive a notification on his/her smartphone or email address.

Article 5: ELIGIBILITY

Access to the E-Clinical service is restricted to major users.

Article 6: PRICING CONDITIONS

Use of the E-Clinical online registration system is completely free of charge.

The tests carried out may be charged, depending on regulatory provisions on referral.

 Article 7: AVAILABILITY AND CANCELLATION

Once registration has been confirmed, the user will be informed of any cancellation by the laboratory by email, or by any other means at the laboratory’s convenience. The user can also modify or cancel their registration directly on the E-Clinical portal.

EUROFINS BIOLOGIE MEDICALE reserves the right to interrupt the availability of the online registration system, if necessary, at any time, and without notice, in particular for preventive, progressive or curative maintenance operations. If the service is interrupted, EUROFINS BIOLOGIE MEDICALE undertakes to inform users by any means and to make reasonable efforts to remedy the malfunction as soon as possible.

Article 8: LIABILITY

In no event shall EUROFINS BIOLOGIE MEDICALE be held liable for:

  • Direct, indirect, material or immaterial loss or damage of any kind whatsoever arising from the use of the online system
  • The impossibility of accessing the system
  • Damage to or alteration of user equipment, including but not limited to computer equipment, mobile terminals or mobile phones

Article 9: SECURITY AND CONFIDENTIALITY GUARANTEES

The data collected via this form are subject to technical and organisational security measures in accordance with the regulations in force (GDPR) implemented by EUROFINS BIOLOGIE MEDICALE including the storage of the result data on servers certified HDS standard ISO 27001.

However, it is up to the user to take all appropriate measures to protect his own data or computer stations used from contamination by possible viruses circulating on the Internet. The user agrees that EUROFINS BIOLOGIE MEDICALE cannot be held liable for incidental, material and/or immaterial, direct and/or indirect damage that may result from access to or use of the online registration taking service, including inaccessibility, loss of data, deterioration, destruction or viruses that may affect the user's equipment.

Article 10: APPLICABLE LAW AND JURISDICTION

These Terms and Conditions are governed by French law. The user agrees that any dispute relating to the interpretation and/or execution of these GTCU will, as far as possible, be settled through amicable negotiations. Otherwise, the dispute shall be submitted to the assessment of the competent court.
