The purpose of these Terms and Conditions is to define for users the terms and conditions of use of the contact form of one of the Eurofins Biologie Medicale laboratories available online on the website under the heading "Contact us"

The use of this service implies for the user the unreserved acceptance of these terms and conditions.

Article 1: PURPOSE 

The online contact system is dedicated to managing requests for information from patients or any other user wishing to contact one of the Eurofins Biologie Médicale laboratories electronically. The form to be completed collects the information necessary to manage the request made for a EUROFINS BIOLOGIE MEDICALE medical analysis laboratory selected from the list available in the form.

Article 2: ACCEPTANCE AND AMENDMENT OF TERMS

Before validating the request, the user accepts these terms and conditions of use. EUROFINS BIOLOGIE MEDICALE reserves the right to modify them at any time and agrees to inform users by any means.

Article 3: LEGAL BASIS FOR THE COLLECTION OF PERSONAL DATA

As part of the use of this form, EUROFINS BIOLOGIE MEDICALE collects your personal data for the exclusive purpose of managing your contact and information requests.

The legal basis for the processing concerns:

  • the legal obligation (Art.6-1/a GDPR) for users with a file number and wishing to contact the laboratory that carried out the relevant analyses
  • the execution of the contract (Art.6-1/a of the GDPR) in order to take measures at the request of contact or information of users who have not already contacted the laboratory concerned.

Article 4: LEGAL BASIS FOR THE COLLECTION OF PERSONAL DATA

Categories of data collected.

  • Personal identification and contact data:
    • Last name
    • Name of the Participant:
    • First name
    • E-mail:
    • FILE RETENTION
    • Sensitive data: data that can be found in the documents that users can attach to their contact request (prescription, health insurance card, analysis results, etc.)

The information provided is intended exclusively for the Eurofins Biologie Medicale laboratory selected from the list made available to the user.

Eurofins Biologie Medicale retains your personal data for the duration necessary for the purpose pursued while respecting the applicable legal and regulatory limits.

If you are a patient of one of the Eurofins Biologie Médicale laboratories, the data related to your file is kept in accordance with the provisions of the CNIL and the General Data Protection Regulation (GDPR of 25 May 2018/Health data retention repository/Simplified standard no.53), in particular the CNIL repository "retention periods – treatment in the field of health (excluding research)", namely for a minimum period of 5 years (from the last intervention on the file) as an active database and then 15 years as an intermediate archiving database (accessible only on request)

If you are a prospective customer, your data is kept for a maximum of 36 months, unless otherwise required by law.

Article 5: USING AND ACCESSING THE FORM SERVICE

Fields marked with an asterisk in the contact form must be completed. Otherwise, the contact request cannot be processed.

Personal information will only be visible to the medical biology laboratory concerned by the request.

 Article 6: AVAILABILITY AND CANCELLATION

All  contact requests result in a confirmation message.

EUROFINS BIOLOGIE MEDICALE reserves the right to interrupt, if necessary, the availability of the online contact system at any time, and without notice, with a view in particular to preventive, progressive or curative maintenance operations. If the service is interrupted, EUROFINS BIOLOGIE MEDICALE undertakes to inform users by any means and to make reasonable efforts to remedy the malfunction as soon as possible.

Article 7: LIABILITY

In no event shall EUROFINS BIOLOGIE MEDICALE be held liable for:

  • Direct, indirect, material or immaterial loss or damage of any kind whatsoever arising from the use of the online system
  • The impossibility of accessing the system
  • Damage to or alteration of user equipment, including but not limited to computer equipment, mobile terminals or mobile phones

Article 8: SECURITY AND CONFIDENTIALITY GUARANTEES

The data collected via this form are subject to technical and organisational security measures in accordance with the regulations in force (GDPR) implemented by EUROFINS BIOLOGIE MEDICALE including the storage of the result data on servers certified HDS standard ISO 27001.

However, it is up to the user to take all appropriate measures to protect his own data or computer stations used from contamination by possible viruses circulating on the Internet. The user agrees that EUROFINS BIOLOGIE MEDICALE cannot be held liable for incidental, material and/or immaterial, direct and/or indirect damage that may result from access to or use of the online registration taking service, including inaccessibility, loss of data, deterioration, destruction or viruses that may affect the user's equipment.

Article 9: LAW AND JURISDICTION

These Terms and Conditions are governed by French law. The user agrees that any dispute relating to the interpretation and/or execution of these GTCU will, as far as possible, be settled through amicable negotiations. Otherwise, the dispute shall be submitted to the assessment of the competent court.
